According to a ruling dated 3-17-20, the Social Court No. 2 of Toledo sentenced an ambulance company to pay its workers as overtime hours that go beyond the ordinary working day, for having had to be on call. It was ruled that the work performed by ambulance drivers, whether at the base or at the workplace, on a 24-hour day and 72-hour rest basis, during the 24 hours, on call, is time of effective work and must be paid as overtime, provided they exceed the 1800 hours established in the Collective Agreement.
The ruling shows that if an employee, by obligation, must remain in a specific place (read base of operations) during guard duty, in practice this means carrying out effective work, and therefore remunerated, in the event that they meet the aforementioned antecedents. .
